On Monday, the Supreme Court dismissed two pleas challenging a Delhi High Court judgment that upheld the Centre’s Agnipath scheme for recruitment into the armed forces. The Agnipath scheme was introduced to streamline the recruitment process and ensure transparency and fairness in selection. It involves a written exam, followed by physical and medical tests, and then an interview.
The bench, consisting of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala, stated that candidates who had already been selected through recruitment processes like rallies, physical and medical tests for defense forces before the introduction of the Agnipath scheme did not have a vested right to appointment. The bench added that it would not interfere with the high court verdict since it had already dealt with all the aspects of the case.
Two separate pleas were filed by Gopal Krishan and advocate ML Sharma against the high court verdict, which was both dismissed by the Supreme Court. However, a third plea related to recruitment in the Indian Air Force (IAF) before the launch of the Agnipath scheme was posted for hearing on April 17. The bench requested the Centre to file its response to the third plea.
On March 27, the Supreme Court had agreed to hear pleas filed against the Delhi High Court judgment that upheld the Centre’s scheme for recruitment into the armed forces. The high court had earlier stated that the Agnipath scheme was formulated in the national interest with a laudable objective of maintaining national security.
